How to Ask Someone to Be Your Executor

Willingness is a crucial quality that an executor should possess. Thus, after identifying the most suitable party to administer your estate, you should ask them if they are willing to accept the position before putting it in your estate plan.

So, how do you approach this conversation?

Below are four tips to help you:

1. Know what to say

Before meeting with your chosen party, you need to plan what to say. Firstly, list their top qualities that are crucial in serving as an executor (why you chose them).

Additionally, list their expected duties – be as clear as possible. You can work with professionals to understand in-depth what is expected of your executor. This way, you can provide them with all the details they need to make an informed decision.

Further, it is best if your chosen party understands the complexity of your estate. Thus, list your properties, including real estate, bank accounts, vehicles, family heirlooms and digital assets (stock options, cryptocurrencies, etc), among others.

2. Be gentle

When you meet with your chosen party, discuss the aforementioned matters gently and encourage them to ask questions.

3. Set adequate time

Set aside one or two hours for the conversation. Pick a suitable time and place to avoid distractions.

4. Give them time to respond

After you have provided your chosen executor with the information they need, let them know they don’t have to answer right away – they can take time to think about it.

Asking someone to be your executor can be challenging. But you can do so with the right tips up your sleeve. You should also consider seeking legal guidance to be well-prepared for this conversation and more.
